The Court of Justice of the European Communities is the judicial institution of the Community. It is made up of three courts: the Court of Justice, the Court of First Instance and the Civil Service Tribunal. Their main task is to examine the legality of Community measures and ensure the uniform interpretation and application of Community law.

Spanish legislation that exempted from tax all winnings from lotteries, games of chance and betting organised by public bodies or entities pursuing social or charitable non-profit-making activities that were established in Spain was a restriction on the freedom to provide services of similar bodies and entities established in other Member States and was contrary to Article 49 EC and Article 36 of the EEA Agreement, as that exemption did not apply to those bodies and entities established in other Member States. Such an exemption could not be justified on the grounds of prevention of money laundering, public health or other socio-economic reasons.

Failure of a Member State to fulfil obligations – Directive 75/442/EEC - Waste - European Court of Justice Judgement - CASELEX:EU:2009:133

Waste waters fell outside the scope of the Waste Directive 75/442/EEC only if, and to the extent that, they were governed by ‘other legislation’ at the Community or local level. Since no other Community legislation regulated domestic waste waters disposed of in the countryside through septic tanks and other individual water-waste treatment systems, the Republic of Ireland was obliged to adopt the necessary provisions, as regards such waste waters. By failing to do so, Ireland had failed to fulfil its obligations under Articles 4 and 8 of the Waste Directive.

Sexual discrimination case - Bulgaria - CASELEX:BG:2009:42

In an action brought by a female worker claiming that she had been sexually harassed within the meaning of Article 5 in conjunction with Section 1(2) of the Protection from Discrimination Act 2003, transposing Article 2(2)(a) in conjunction with Article 1(d) of Directive 2006/54/EC, the testimony of witnesses reproducing her story was valid evidence -- not of the circumstances known only to the harasser and the victim but of the victim's behaviour, remarks and reactions to the harassment - Judgement by Bulgaria's Supreme Administrative Court.

Passengers whose flights are delayed may be entitled to compensation

Air travellers in Europe faced with a delay of three hours or more are entitled to compensation, following a judgement by the European Court of Justice. The judgement clarifies the rights available to airline passengers who have undergone delay. It was ruled that a delay totalling three hours or more would entitle the passenger to compensation.

EU Court upholds graphite cartel fines

The European Court of Justice has upheld fines, totaling EUR 101.4 million, imposed by the European Commission in 2003, on some of the region's top industrial groups for their role in a cartel that fixed the price of carbon based products.

Commission seek cross-border cooperation on evidence in criminal matters

The existing rules on obtaining evidence from another Member State consist of a number of co-existing instruments based on different underlying principles and scopes. This makes the application of these rules burdensome and may cause confusion among practitioners, and lead to situations where they do not use the most appropriate instrument for the evidence sought. Ultimately, these factors may therefore hinder the course of justice, and effective cross-border cooperation.
