Details

Directorate Institutional and General Legal Matters (D 5.3.1) forms part of the Principal Directorate Legal Services (PD 5.3), the central legal service of the European Patent Office (EPO) for non-patent law questions. D 5.3.1 has two departments, "Institutional Law and Litigation" and "General Law and Contract Law" providing legal advice on amending EPO internal regulations, institutional and procedural reforms, applying the Protocol on Privileges and Immunities of the European Patent Organisation (PPI), drawing up legal texts and resolving legal disputes. They also provide legal advice on tenders and critical contract matters, also in relation to technical and other co-operation with member and non-member states and the European Union.

Your main responsibilities

  • Providing legal advice on (international) tender and contractual matters, drafting contracts and participating in or leading related contract negotiations
  • Providing legal advice in relation to co-operation with member and non-member states and the European Union and on the terms/policies of such legal co-operation schemes
  • Safeguarding the interest of the EPO in liability issues and upholding the legal status of the EPO and its staff Office-wide
  • Taking part in legal proceedings, in or out of court
  • Providing legal advice on non-contract matters, especially involving the European Patent Convention, the PPI and seat agreements with host countries (including safeguarding and enforcing the status of the EPO); helping to draw up or revise the EPO's international agreements; conducting comparative studies
  • Advising on amending EPO internal regulations (e.g. Financial Regulations, implementing rules, Regulations for the Reserve Funds for Pensions and Social Security, the European Patent Academy, the Boards of Appeal), and drafting internal legislative proposals and supporting their implementation
