Court scraps Euro-Parliament's chauffeured cars contract
(LUXEMBOURG) - A court on Wednesday annulled the European parliament's chauffeured cars contract, ruling that it broke rules on tendering.
The ruling came at the end of a case brought by unsuccessful bidder VIP Car Solutions which claimed the bidding process lacked transparency as parliament failed to provide details of the relative merits of the successful tender.
In its judgement, the Luxembourg-based Court of First Instance said that the parliament's response to a request by VIP for a full explanation of why it lost out to its rival Biribin, even though its tender was lower, was inadequate.
"In its reply the Parliament confined itself to stating that, although the price bid by VIP Car Solutions was slightly lower than that of the company selected, the latter's tender received the highest marks for all the award criteria taken together," the European Union court ruled.
The parliament's actions did "not show clearly and unequivocally the reasoning which it followed" it added.
Although the court ordered that the contract with French company Biribin be annulled, it refused a claim by VIP for 500,000 euros in damages as not "even the most basic details" of the company's alleged loss had been provided.
The case dates back to September 2006 when the EU parliament sought tenders for chauffered cars and minibuses to take its members to the parliament's monthly plenary sessions in Strasbourg.
Under the announced terms the contract was to be awarded to "the most economically advantageous tender," with price accounting for 55 percent of the overall evaluation.
The contract was awarded to Biribin in January 2007, a decision then challenged by its fellow French firm VIP.
The parliament's judicial services were studying the ruling, a parliament spokesman said. An appeal is possible.

Come on chaps, where is your sense of honour and pride?
While you are trying to fool the public that there is no fancy footwork in the EU parliament with piddly little examples like the driver's contract, the real horsethieves are getting away with ripping off the public funds.
Some of you are just as bad as that has been canadian prime minister that has been lying to the canadian public for a decade or more.
What was his name??
Lying brian or brian balony as the canadians have been calling him since his disgraced departure from politics in 1993.
My oldest son sent me the recordings on DVDs of the latest hearings on CBC on whether he took bribes from a german middle man trying to sell airbus aircraft to air canada etc etc.
This german middle man has been claiming for years that he has paid lying brian 300,000 dollars in cash on three or four occasions in hotel rooms in canada and New York. And for about ten years lying brian has been saying " he had no dealings with that man except had some coffee with him once or twice, that is all.
He sued the canadian government for defemation of his name for 2.5 million dollars and the stupid chretien government paid him off without asking any questions.
Do the math. That is almost 3 million dollars pocketed by this man and if it had not been for the investigations of the CBC (canadian broadcastin corporation) the truth would have been brushed under the carpet for good.
After It was documented and proven that this lying and dishonest politician did meet with the german middleman several times and was given 300,000 dollars in 1000 dollar notes in cash in envelopes, he had no choice but admit that he took the money.
Ten years after the fact, left with no other alternative but admit the truth, he declared taking 225,000 dollars as a retainer. For almost a decade he paid no income tax on that money and actually got away with it as well.
Let an average canadian resort to a crooked plot like that and the canadian tax agency would take him/her to the cleaners with penalties and accrued interest plus a jail sentence.
This asshole is getting away with something like 37,000 dollars tax payment after a decade only because he is an irish horsethief who happened to become the prime minister for no traits other than his gift of the gab.
He was totally inept as any other irish horsethief but considered himself the gift to the canadian public encouraged by the attention he received from his distant kin in Washington - that half wit star gazing, star wars fanatic raegan - another inept irish asshole that almost bankrupoted the US economy.
They used to get together every three months or so for photo opportunities to feel good about themselves while the economy in canada and usa was royally screwed up.
When george bush (older) was elected the first thing this creep did was to invite himself to the white house expecting the same welcome as before. At the news gallery he siddled up to george like he used to do to ronny like a faithful little dog but george was not having any of that and elbowed him off the podium. That appeared in the live reporting session mid afternoon but was removed quickly soon after. What a disgrace to the canadian nation that was.
Anyway, this creep now, claims that he made a fatal mistake dealing with "that" german middleman, cries during the hearings and claims that he has never done anything wrong in his life except take the advise of his lawyers blah blah blah..
He drags all his family to these hearings and claims that his family is suffering because of the lies of "that man".
What about his lies for the last dozen or more years to the canadian public???
What about hiding that cash bribe stuffed into bank safety deposit boxes and hidden from the tax collectors??
What about the continuing lies and deceits while he claims another 2 million dollars from the tax payers to pay his lawyers and to maintain his life style.
He states that the British treat their prime ministers with utmost respect even years later while the ungrateful canadian public don't kiss his feet!!!!
What is wrong with you canadian public??
You elect these typically inept, incompetent and often crooked irish politicians because they have the gift of the gab - and nothing else - then you deserve to be taken for a ride - time after time.
Wake up and learn somethings from the British.
Yes there are crooks in the British politics as well but look what happens when the truth emerges. The prime minister rubs their noses in dirt right away. The speaker of the House of Commons resigns his post even though he had nothing to do with the crooks.
And that is just the beginning.
So canadians, wake up and instead of paying this horsethief another 2 million dollars of your tax monies demand justice and make sure that he returns the first 2.5 million to the government and pays his taxes and panalties and serves his sentence just like any criminal canadian would.
In jail.
And what the hell is the present canadian prime minister doing about making sure that justice has been served.
Not a thing.
They belong to the same party and hob nob in the same circles!!!
And as for the horsethieves in the EU parliament!!! The going may be good for now but your day in front of a judge will surely come.
